Building a house in a tree could result in a fine

Fun in the form of building tree houses owes its appearance to books and movies of the genre of “fantasy”, in which elves and other mythical creatures from ancient legends live in trees.

However, not everywhere you can fully feel like an elf. It is forbidden to build houses or huts on the trees of forest lands. Such construction is forbidden on land owned by a settlement.

It is possible to implement such projects only on your own plot of land with an authorized type of use. This may be a dacha, residential housing, gardening, personal subsidiary farming.

All trees on a plot of land are the property of the owner, so he can build anything he wants on them. Ksenia Bogdanova, Information Policy Advisor to the Director of FGBU Roslesinforg, commented on the question.

“Exactly so. But we should not forget that if, due to construction, a tree falls on a neighboring house or car, the neighbors can apply to the court for compensation for damage. However, for this they will have to prove that the tree fell due to your fault,” Ksenia Bogdanova told RuNews24.

There are no rules on how and where to place a tree house on one's plot. Therefore, the builder will have to be guided by general SNiPs, including fire safety measures.

It is necessary to observe the distances between the buildings on the site and indents from the fence. So, a dog kennel, for example, should be located no closer than four meters from the fence of the site.

In the event of a violation of the regulations, neighbors and local authorities may require the unauthorized building to be removed. This can happen if the object does not meet the criteria for area and height.

As already mentioned, it is not allowed to build on trees of the state forest fund. There are a total of 45 types of permitted forest use, and none of them involves the construction of houses on trees.

It is allowed to build non-capital constructions - arbors, sheds when renting a forest plot for recreational activities. Rope parks and other leisure facilities can be located on such plots.

However, no structures should be attached to trees so as not to damage their bark and prevent their natural growth and development, including crown formation.

The land under a forest tree is federally owned, so any self-rule in the forest is strictly punishable. It is impossible to lease or buy a tree on the root to build a house on it.

Illegal actions - using a tree as a support, hanging swings or hammocks from it can result in fines. An individual will pay from three to four thousand rubles, an official - from 20 to 40 thousand rubles, an organization - from 200 to 300 thousand rubles.

An exception is made only for small-numbered indigenous peoples of Russia for traditional farming. These are Nenets, Khanty, Dolgans, Yukaghirs, Tofs, Selkups, Veps and Chukchis. To them the lands of the forest fund can be transferred free of charge for an indefinite period of time.

For these peoples, tree houses have historically served as shelters for supplies from predators and the elements. These structures are simple elevated covered platforms built without nails, staples, or harm to trees.
