The Government has proposed to withdraw the status of lawyers who have left Russia. The Cabinet of Ministers wants to make an amendment to the law "On Advocacy". This was reported in the Federal Chamber of Lawyers.
Amendments to the bill "On advocacy and advocacy" prepared by the Commission of the Cabinet. The document was developed by the Ministry of Justice and the FPA. It was submitted to the State Duma in February this year. The bill toughens the requirements for candidates for lawyers. In addition, it is proposed to introduce a unified state register of lawyers and regulate the general lawyer information system.
The Cabinet proposes to supplement the law with the following provision: the Council of the Bar Association in the presence of the conclusion of the qualification Commission in the case of departure of the lawyer for permanent residence outside Russia for a period of more than one year to deprive him of the status of an attorney.
The status will not be deprived of those lawyers who leave the country for training, medical treatment or accompanying family members and other valid reasons.
The authors of the amendment explain that the lawyers who left Russia continue their work and it may undermine confidence in the institution of the Bar. Vice-President of the FPA Oleg Bakulin believes that the proposed measures are not a repressive mechanism. According to him, the text of the amendments may change to the second reading in the State Duma.
